Grounds for divorce in New York

New York is a "fault" state which means that you need to have a statutory ground to file for divorce. Attorney Beth Locastro can clearly explain the grounds for divorce in New York. Some examples of the grounds are as follows:

In an uncontested divorce, one party files for divorce and the other party defaults and thereby waves their time to respond. The party is served with divorce papers, does not respond and by default agrees to the divorce.

Separation agreements may be required in uncontested divorces depending upon the parties individual circumstances.  Separation agreements can also be used to settle contested divorces. Separation agreements provide directives for custody, visitation, child and spousal support. Additionally, marital assets and debts are divided. Marital assets and debts can include the marital home, debts, pension plans, personal property, bank accounts and loans.
